Capital gains tax on real estate is the tax paid to the State of Israel (as opposed to the betterment levy paid to the municipality) for the profit accumulated by the property you purchased from its acquisition to its sale, minus the expenses incurred for purchasing or improving the property.

Israel’s capital gains tax rate is 25%, as of November 2023.

The factors determining the amount of tax you will pay include: the type of property (residential apartment or other rights), the date of property acquisition, and the difference between the purchase value of the property and its sale value.

If you own one residential apartment used for living and you have not sold a property exempt from tax in the last 18 months, you will be exempt from capital gains tax on real estate.

Note: There are ways to reduce capital gains tax on real estate, such as showing expenses incurred on the property being sold, renovations if any, attorney fees, etc.

Under certain conditions, a letter of agreement can serve as a contract. An agreement is legally binding if there is evidence of a clear offer, acceptance, and intention by the parties to commit to each other.
